Attorney For Chicago Police Officer Seeks Change of Venue
Herbert said after the hearing that he was considering requesting a change of venue for his client because of comments made by Mayor Rahm Emanuel.

A Cook County grand jury indicted Jason Van Dyke on six counts of murder and one count of official misconduct on Tuesday, three weeks after prosecutors filed the original murder charge against him. Van Dyke, who is white, was indicted earlier this week and was scheduled to appear before a judge at noon CST Friday in Cook County Criminal Court, the Associated Press reported.
In November, a judge ordered for dash-cam video to be released of the incident in which McDonald was shown moving away from the officer as he was sacked upon. A couple of people confronted Van Dyke as he left the courtroom Friday., shouting profanities & pounding on the black pickup truck during which he departed.
“Sixteen shots!” “Murderer!” “Child killer!” a small group of people yelled as they tailed 37-year-old Van Dyke outside the courtroom.
Herbert told reporters he wants the trial moved to a county “outside the reach” of Mayor Emanuel’s comments. Van Dyke, faces six counts of first degree murder and a count of official misconduct in the October 2014 shooting of McDonald, 17.
Chicago police killed an average of 17 people a year over the last seven years, majority African American, and it is extremely unusual for police officers to face charges or be disciplined in such cases. Van Dyke shot the teen 16 times in a 2014 shooting captured on a squad vehicle video.
The mayor has faced calls to resign from protesters who accuse City Hall, the police and the state’s attorney of a coverup because the city fought for months to keep the video from being released under the argument that doing so would hinder the investigation into the shooting.
Similar complaints have been raised for years but Wooten says he and others believe now is the time to affect change while the federal Department of Justice is investigating Chicago Police. On that date Van Dyke is expected to enter a plea, and a trial judge will be assigned to the case. The phone number is 844-401-3735.

The DOJ announced the investigation on December 7 soon after the release of video showing a white Chicago police officer fatally shooting a black teenager.
