Actress Morena Baccarin is facing a new challenge from her estranged husband Austin Chick as he has moved back to Los Angeles after previously agreeing to co-parent their young son in NY City.

According to court documents, around the time that Morena got pregnant with Ben’s child, Austin was under the impression that they working on their relationship.
The 36-year-old actress and her 44-year-old ex entered a custody battle over their child, which she won, allowing her to keep the boy in NY where she shoots the Batman prequel drama series. Baccarin and Chick share legal custody of their son, though she is the primary caretaker.
While she and Chick came to an agreement that Julius should spend about 18 days per month in the Big Apple, he has now reportedly refused to oblige.
On Tuesday (Nov. 10),ET received legal documents stating Chick “changed his mind” about relocating to NY City, where Baccarin films her Fox show Gotham, as per their discussed child custody.
The court also notes that Baccarin’s OBGYN claims the pregnancy is high risk and that she should avoid extensive air travel – another reason for her to remain with Julius in NYC instead of flying back and forth from LA. He “shipped a few furnishings there and truly stayed there with the kid for about two weeks in Jul.,’ the papers claim”. He allegedly claimed that Baccarin and McKenzie had started dating while they were still married. Chick filed for divorce in June citing “irreconcilable differences”. “Also, I am 3 1/2 months pregnant”.

Baccarin made her debut on Gotham earlier this year as Dr. Leslie Thompkins, the love interest of McKenzie’s leading character, Police Commissioner James Gordon.
