Bill Cosby could get trial date at evidence hearing Tuesday

Ms Constand said she had thought the pills were herbal products and that she was later floating in and out of consciousness. A hearing will be held at 9:30a to determine whether there is enough evidence to move to trial. A trial date has not yet been set.

Cosby is required to attend the hearing.

They hope to suppress several days of testimony Cosby gave in the accuser’s lawsuit a decade ago. Cosby acknowledged giving Andrea Constand several pills before what he calls a consensual sexual encounter.

Cosby’s lawyers want that deposition thrown out of court.

Cosby had countersued some of them.

Castor said he made that promise so the entertainer would not be able to use the Fifth Amendment to avoid answering questions in a deposition, according to an email from Castor to his successor, Risa Vetri Ferman. District Attorney Kevin Steele will fight to use them at trial. Prosecutors say he drugged and molested her.

The deposition was sealed when the parties reached a settlement in 2006.

Cosby’s lawyers also will push to suppress key evidence, including the deposition Cosby gave in the accuser’s 2005 lawsuit. Cosby has denied all those accusations.

The secretly-recorded phone conversation took place a year after the alleged sexual assault and was described by Cosby in the 2005 deposition as “I’m apologising because I’m thinking this is a dirty old man with a young girl”.

The lawyers say he didn’t know Gianna Constand was recording when he called her in Pickering, Ontario, from his home in California. Canadian law meanwhile allows for one-party consent.

Cosby’s lawyers say that he was told he would not be charged as a result of what he had said but this year a judge ruled that he had never been granted immunity from prosecution. She says Cosby drugged and assaulted her at his Cheltenham home in January 2004.
