Cauvery dispute: Karnataka may defy SC order, spark constitutional crisis

Defending the boycott of a crucial all-party meeting convened by Chief Minister Siddaramiaah on the Cauvery row, State BJP President B.S. Yeddyurappa said his party has developed a feeling that Mr Siddaramaiah wants to make BJP a “culpable-partner” in his ‘sins of omission and commission.

After a late night cabinet meeting, Karnataka Chief Minister Siddaramaiah said it has been made a decision to defer the release of more Cauvery water to Tamil Nadu.

“If an elected government says because of law and order problem it can not comply with our order, then let it go”, a three-judge Bench of the Supreme Court had orally observed when the Tamil Nadu government filed a contempt of court petition against Karnataka. At the meeting it was decided that a final decision should be taken following a special legislative session of the both the houses on Saturday.

The government, they said, based on a decision by the legislature against the release of water, could go before the Supreme Court pleading “helplessness” in obeying the court’s direction for releasing water, in view of conflicting directions from two constitutional bodies.

Deve Gowda on Wednesday advised the Chief Minister Siddaramaiah against releasing water to Tamil Nadu, as directed by the Supreme Court on Tuesday.

Chief Minister Siddaramaiah had termed the Supreme Court’s order as “unimplementable” on Tuesday.

Chief Minister Siddaramaih who, has termed the Supreme Court’s order as “unimplementable”, is now chairing Council of Ministers meeting at Vidhana Soudha, the state secretariat to decide on the further course of action. The BJP has been insisting that the government should not release water to Tamil Nadu due to the distress situation.

The Supreme Court yesterday directed the Centre to constitute within four weeks the Cauvery Water Management Board (CWMB) as directed by the Cauvery Water Disputes Tribunal (CWDT) in its award. “Though belated, it is a welcome decision”, he said.

At an all-party meeting earlier in the day, all political parties in Karnataka baring principal opposition BJP, recommended against releasing water to Tamil Nadu. City police has prohibited sale of liquor and opening of bars, wine shops and pubs from 6 AM today to 1 AM tomorrow in the commissionerate limits.
