A Baltimore police officer has been arrested in the December 2014 shooting of a burglary suspect, the state’s attorney’s office announced Wednesday. That suit was filed on behalf of a client by the lawyer who also represents Freddie Gray’s family.

Mosby, who some praised and others criticized for coming down hard on police in the Gray case, said the Cagle charges were based on the facts of the case and nothing more. “In fear of their safety, those two officers discharged their departmental issued firearms multiple times, striking the burglary suspect several times and causing him to fall to the floor”.

While Leary and Smith were covering him with their guns drawn, Mosby said, Cagle walked in and stood over him with his gun drawn.

The Baltimore Sun reported that Attorney Mosby said the first two cops were justified in shooting because the suspect refused to adhere to commands and made a move toward his waistband.

The suspect was transported to a local hospital and survived.

Mosby said no weapon was recovered from the man. The three other officers involved were cleared of any wrongdoing.

Cagle, who has turned himself in, was additionally charged with attempted second-degree murder, first-degree assault, second-degree assault and use of a handgun in a crime of violence, WBAL-TV reports.

“Today’s serious criminal charges against a Baltimore Police Officer happened because our internal investigations worked”. “That’s a punch in the gut”. It doesn’t make police officers feel very good. “But what’s really important here is that the integrity of our profession, the integrity of our agency, wins out”.

He was a 14-year veteran of the force assigned to the Eastern District. As of Wednesday, Cagle had been suspended without pay.

Asked about the viability of the charges, Mosby said: “We’re going to let justice run its course, and that will be up to a judge or a jury to determine”.

Those officers acted within police department protocol, according to a statement from the office of the state’s attorney. The lawsuit alleges that the officer then tossed her inside a police van and handcuffed her but did not put a seatbelt on her. As a result, the suit alleges, Brooks “was thrown about and injured as the wagon was driven”. In the last incident, Officer Tommy Sanders was charged with manslaughter in the shooting of an unarmed man. Sanders was acquitted of all charges in 2010. Records show a settlement was reached, but detailed information was not available late Wednesday.
