While this does some odd on its face, the fact that the family was represented by counsel and apparently involved in negotiation with the city prior to the time the settlement was announced would suggest that the intent to take those steps was quite obviously there and that the settlement came after negotiations between the city and the family created to avoid the costs associated with going forward.
