Competency of man accused of supporting terrorism questioned

Prosecutors say Nagi espoused “violent jihad” and was preparing to travel Turkey for a third time to join the self-proclaimed Islamic State.

Nagi’s defense attorney points out that none of what his client is accused of doing is inherently illegal, and he says, political speech, no matter how unpopular, is protected by the First Amendment. He declined to elaborate.

A federal judge gave his preliminary approval Monday to a mental health exam for accused ISIS supporter Arafat M. Nagi of Lackawanna.

“We’re not aware of any concerns”, said Assistant U.S. Attorney Timothy C. Lynch.

Investigators say Nagi bought a machete and other gear, posted photos of severed heads on social media and pledged allegiance to leaders of Islamic State group on Twitter.

“I think racial, religious issues might come up that we’re concerned about”, he added.

He said the pre-trial discovery phase of the case would be complicated because it will likely involve classified information. He has been held without bail since his arrest when the federal complaint against him was unsealed July 29.
