Cosby to face trial over model’s defamation lawsuit

A judge is scheduled to consider whether to dismiss a defamation lawsuit against Bill Cosby that was filed by model and TV host Janice Dickinson.

Dickinson sued Cosby in May past year after he denied the allegations he drugged and raped her in Lake Tahoe in 1982.

Los Angeles Superior Court Judge Debre Katz Weintraub denied a motion by Cosby’s attorney, Christopher Tayback, to toss the allegations on grounds that former Cosby attorney Martin Singer expressed an opinion when he issued a November 19, 2014, news release concerning Dickinson’s truthfulness.

“Janice is going to fight and she will not let this diagnosis define her”, Bloom tells ABC News.

“I will not go down”, she said at a press conference following the ruling. Dickinson brought a suit against Cosby for defamation in May 2015, after his lawyers claimed that Dickinson lied about her assault.

The former sitcom star has been deposed (as has his wife Camille) in several other defamation cases, and earlier this year he saw two potential criminal cases tossed out because they failed to meet the statute of limitations. Dickinson’s suit states Cosby’s denial caused her to feel re-victimized. Dickinson, 61, claims Cosby raped her in 1982. “I want him to stand under oath”.

However, Savannah, 22, was out shopping with her mother when she got the call to confirm the diagnosis, and Janice admitted, ‘I just was really glad that my daughter Savannah, she likes to be called Savi, I was really glad Savi was with me at that moment because it was kind of an out of body experience.

Dickinson was then cast as a member of “The Surreal Life” show on VH1 and “America’s Next Top Model” on UPN.

There’s no date for the trial yet, and Cosby’s lawyers will have the opportunity to continue to try to keep their client out of court.

On Tuesday, Dickinson’s attorney and frequent MSNBC contributor Lisa Bloom, applauded the judge’s decision on social media. According to Deadline, one of the battles fought on Tuesday, over legal fees, was a draw, with Weintraub not ruling in favor of either side.

More than 40 women have come forward to publicly accuse Cosby, 78, of assaulting them over four decades. Cosby remains free on $1 million bail.
