The judge ruled that Kanu’s continued detention for over two months showed that the DSS lacked sufficient material to prosecute the Radio Biafra chief or was still undecided on what to do with him.

Earlier on Wednesday, Shuaibu Usman of the magistrate court in Wuse zone 2, Abuja, discharged Kanu, on all counts of criminal conspiracy, intimidation and leading an unlawful society brought against him by the Department of State Services (DSS), under the Federal Government.
Mr. Usman said since the SSS, through its lawyer, had filed for a discontinuation of the case, he had no option than to discharge the accused.
The DSS requested the court to discontinue Kanu’s trial on November 23, in order to charge him with terrorism before a higher court.
He added that from the available facts before the court, the Department of State Services were not ready to grant bail or put Mr Kanu on trial. IPOB is demanding his immediate and unconditional release. The court threw out the government’s objection to Kanu’s release on ground that he constitutes a “threat” to public peace.
According to Vanguard, the court reached the decision today, December 16, 2015, after the DSS withdrew its case against Kanu.

Mr. Idakwo claimed that the DSS had evidence of bank accounts owned by Mr. Kanu, who holds dual citizenship of Britain and Nigeria, where monies (both in dollars and pound sterling) were allegedly used for financing acts of terrorism against the country.
