Cruz Eligible for GOP Primary in Illinois: Judge

Cook County Circuit Court Judge Maureen Ward Kirby in Chicago found that she did not have subject matter jurisdiction over the case because the plaintiff, Lawrence Joyce, did not properly file his petition for judicial review.

The defense of Cruz’s place in the election is being argued by the New York Board of Elections, which put Cruz on the ballot, NBC added.

Mr. Cruz has never denied being born in Canada, but maintains that the issue is ridiculous because under longstanding US statutory law, he was automatically a USA citizen at birth because his mother was a USA citizen.

Ted Cruz’s presidential eligibility Tuesday – one of four cases around the country aiming to kick Cruz off primary ballots. The Illinois primary is on March 15, but early voting has already begun. Donald Trump has also openly questioned Cruz’s eligibility. His father was a native of Cuba.

House Minority Leader Nancy Pelosi wouldn’t say whether she thought Cruz was a “naturally-born” citizen when asked about it at her weekly press conference.

The case was scheduled to be heard at an inopportune time for Cruz: He has staked his entire campaign on a strong performance on Tuesday, when 11, mostly Southern states, will vote. She said she could not look at the issues presented in the case because it was not properly before her. Opinion polls indicated the billionaire businessman would dominate in Tuesday’s contests in every state but Texas.
