Known as “Jane Doe” in the court filings, the 30-year-old Los Angeles woman originally filed a lawsuit back in August 2015, accusing Rose and two other men of breaking into her apartment and raping her in 2013. “The answer: ‘No, but can you tell me?’ The questioner: ‘I just wanted to know if you had an understanding.’ The answer: ‘No'”. He just knew that’s how I was.
Consent is a huge factor in this case, and was a primary factor for the judge’s decision to deny Rose’s Motion for Summary to get the case thrown out in June. Bill Cosby is fighting allegations by dozens of women who say he drugged and sexually abused them. Rose admits to having group sex with the woman on the night in question, but he claims it was consensual.
“He and his friends.essentially decided they would have sex with her no matter what”, McCoy said during the call. Eventually she left the party and returned home. Rose’s reputation and endorsement potential could take a hit, and the woman has said she wants to spare her family from anything about the case and her past relationships.
“When I woke up”. The woman said she was incapacitated after drinking heavily, has only a vague recollection of the men being in her room, and awoke the next morning in pain and confused about what transpired. “So I had the dress and it was up on my neck and I felt very wet and slippery. I would say closest to a knee rug burn”.
The woman, a college student who also works, said she was reluctant to pursue legal proceedings but ultimately made a decision to take action because of the pain and suffering the incident has caused her. His accuser is asking for a judgment of more than $20 million in the civil suit.
The woman said the past few years have been an emotional “roller coaster”. Both sides acknowledge a settlement remains a possibility.
Anand: I can say actually that Derrick definitely could not, because we asked him that question in his deposition, and his response was, ‘No, can you tell me?’
The woman said remaining anonymous protects her safety, prevents her from being a target and keeps her family from knowing about the incident.
“She was scared and didn’t know what happened”.
In court filings, Rose’s lawyers said the case is not about an assault but a maneuver by the plaintiff for money. “Rose and the plaintiff”, attorney Mark Baute wrote in a statement to The Associated Press. They urged the National Basketball Association and the Knicks to investigate and discipline Rose. Considering that investigators still haven’t ruled out charging Rose with a crime, though, there’s obviously still a chance that Adam Silver could intervene – which, it goes without saying, should absolutely be the least of anyone’s worries at the moment.
Rose and the woman’s account of the night differ in several key respects.

“He knows what he did now”, the woman said. I just feel that he’s in a bad place.
