Eva Carneiro ‘seeking constructive dismissal claim against Chelsea’

Carneiro was dropped from first-team duties after boss Jose Mourinho said she was “naive” for treating Eden Hazard during a draw with Swansea.

In a ruling, the Football Association ruled that Jose Mourinho will not be charged for allegedly making offensive utterances directed to doctor Carneiro, a ruling that elicited protest from Women FA and Doctor Carneiro.

According to the Telegraph’s Ben Rumsby, Carneiro stands to sue Chelsea for “hundreds of thousands of pounds” should the case reach tribunal, and perhaps even if a settlement is reached before then.

The FA and Carneiro disagreed whether she was given a chance to contribute to the investigation, with the 42-year-old saying she was “at no stage requested by the FA to make a statement”.

However, the FA said she was given an opportunity.

Express Sport understands that legal papers were served on the club this week and these will trigger a potentially embarrassing employment tribunal, unless an out-of-court settlement can be agreed. The three-month period in which a claim must be notified ends on November 8, 2015.

It’s added that cases such as these “are usually settled before” a public hearing can take place as the accused may run the risk of being embarrassed depending on the details of the claim.

It was not immediately clear what the club’s stand is on the matter, owing to their previous pronouncements that they can not comment on internal staffing matters.

Mourinho was seen losing his temper on the touchline as his team – who were already down to ten men following Thibaut Courtois’ sending off – were set to be cut to nine players at a crucial point in the game.
