Today’s order by the U.S. Court of Appeals for the Second Circuit-denying both a panel rehearing and rehearing en banc-means that Brady’s four-game suspension for using underinflated footballs in a 2015 playoff game will stand.
Another report from NFL.com has revealed that Brady now has ninety days to appeal that decision and take the issue to the Supreme Court for an absolutely final decision.
But, don’t get it twisted, Dareus isn’t going to pass up the opportunity to hand another W on the wall even if Brady isn’t available to the Patriots in Week 4. Whatever Brady did or didn’t do, or was or wasn’t aware of, the court has once again made clear that he must serve the suspension imposed by Goodell. Now, fans are anxiously waiting to see if Brady will appeal that decision and go straight to the top – the United States Supreme Court.
The Supreme Court accepts around 80 cases from about 7,000 requests each year. Brady’s team will nearly surely ask for a “stay” of the suspension, and if he is granted that he could still play in Weeks 1, 2, 3 and 4.
He added: “You don’t have to do what Tom Brady does, you do what Jimmy Garoppolo does well”.
“We are disappointed. The track record of this league office when it comes to matters of player discipline is bad for our business and bad for our game”. We have a broken system that must be fixed.
McCann said if Brady moves forward, his chances of success remain slim.
Simply by filing with the Supreme Court, Brady enables the possibility that his suspension could be placed on hold pending the outcome of his petition.
Further, ESPN’s Kevin Seifert casts doubt in an opinion piece on how effective going to the Supreme Court would be for Brady and the Patriots. In fairness to Dareus, his team is only 1-8 in games played against the Patriots in his career, so it would undoubtedly feel better if he could get that second win against one of the best quarterbacks in National Football League history, rather than that guy’s backup. “If it was my kid, I’d say: ‘Let it go'”. New England historically plays its best football in November and December.

But this time, the star quarterback of the New England Patriots will need help – and incredible good fortune – from the nation’s highest court to pull out another victory.
