Rahami’s public defender had asked he be brought to court Wednesday to face federal charges, but authorities said that could not happen until he was removed from the hospital in New Jersey, where he is in custody on the shootout-related charges, and brought to NY.

The FBI said these two men are not wanted but instead wish to speak with them as potential witnesses.

The men apparently found the luggage on the sidewalk, took out its contents – possibly without even knowing they were handling an explosive device, left the bomb on the pavement and walked away with the bag.

In a criminal complaint against Rahami filed in federal court Tuesday evening, prosecutors outlined a terrorism campaign that they said was carefully planned and motivated by Islamic extremism.

Ahmad Khan Rahami is taken into custody after a shootout with police. The complaint was filed in the US District Court for the Southern District of NY on Tuesday and another one was filed in the District of New Jersey.

Bombing suspect Ahmad Khan Rahami, 28, was arrested on Monday after a gunfight with police in Linden, New Jersey.

Ahmad Rahami – in a handwritten screed found on him and released by prosecutors – made references to Osama bin Laden, American-born Muslim cleric Anwar al-Awlaki and former Army officer Nidal Hasan, who went on a shooting rampage at Fort Hood, Texas.

Investigators are looking into whether Mr Rahami was radicalised during previous trips to Pakistan and Afghanistan.
