Democrats have not had a majority on the Supreme Court for more than four decades – since President Richard M. Nixon’s first year in office.

Amid the uncertainty, including the future of the Supreme Court itself, is the status of the 50-plus cases the court has heard or has yet to hear. No chance say the Republicans, who want to wait until after the November election.

In a particularly heated confrontation, Mr Trump accused Mr Bush’s brother, former president George Bush, of having lied to the public about the Iraq war. “I hope he does it as soon as possible and I hope that the Senate confirms and begins deliberations as soon as possible”.

Obama first nominated him to the post in 2012, and the Senate confirmed him, 97-0, in May 2013, including votes in support from GOP presidential contenders Sens.

There are risks to both approaches: A Republican obstruction of a liberal nominee would animate the Democratic Party’s progressive base in an election year but would leave the court without a potentially tie-breaking vote for perhaps a year.

“But in return for that, there should be a consensus orientation on that nomination, and there’s no doubt in my mind that Barack Obama will not have a consensus pick when he submits that person to the Senate”. He was the longest-serving justice on the Supreme Court and was well-known for passionately opposing abortion and strongly supporting the death penalty.

Throughout his career, the outspoken justice was a vocal opponent of abortion and gay rights, often writing scathing dissenting opinions.

Another potential nominee is Paul J. Watford, a judge on the U.S. Court of Appeals for the Ninth Circuit. But because only three of the liberal Justices are participating (Justice Kagan is recused), conservatives would retain a narrow majority.

Not all the Republicans said Obama should skip a nomination fight.
