If a homeless individual refuses to go to a shelter, they can also be taken involuntarily to prevent them facing any harm – such as hypothermia, serious injury or death.

But human rights lawyers have criticized Cuomo’s executive order, saying it violates the autonomy of homeless citizens. “And I think we can do a lot of good together”, he said.
Karen Hinton, a spokeswoman for Democratic New York City Mayor Bill de Blasio, voiced the mayor’s opinion on the homeless subject.
Cuomo announced his executive order on Sunday to protect the homeless.
“We support the intent of the executive order, but to forcibly remove all homeless individuals in freezing weather, as the governor has ordered, will require him to pass state law”.
According to New York City’s Department of Homeless Services, over 57,000 homeless people are living in shelters in the city. Both de Blasio and Cuomo have offered different strategies for alleviating the state’s homelessness problem, often criticizing one another’s plans.
According to the New York Daily News, the emergency declaration is just the first part of what will be the governor’s comprehensive plan to address homelessness. Many of them fear falling victim to crime in the shelters.
He said he believed the law was on his side. It also requires homeless shelters to extend their hours of operations so that those without shelter can remain indoors. She says there are many legal questions about how homeless people could be forced off the street and into shelters without violating the rights of homeless people.

“We want to make sure that every New Yorker has a place to be sheltered and don’t have to be in the cold weather”, he said on 1010 WINS Sunday morning.
