During a November 24 news conference to release the video, Emanuel mentioned the officer by name and said it was clear his actions were wrong.

A Cook County grand jury indicted Jason Van Dyke on six counts of murder and one count of official misconduct on Tuesday, three weeks after prosecutors filed the original murder charge against him. Prosecutors said Van Dyke fired 16 shots in 14 to 15 seconds, and for all but one of two of those seconds, McDonald was already lying wounded on the pavement on October 20, 2014.

As Van Dyke was exiting the courthouse, his attorney, Daniel Herbert, told reporters he was considering seeking a change of venue out of Cook County for the officer’s trial. He says Van Dyke will attend.

Van Dyke, 37, is out on bail.

“We don’t think we could get a fair trial in the County of Cook…We have the police, policing the police”, McDonald’s great-uncle Marvin Hunter said. “If I do challenge the change of venue, I would imagine the mayor’s comments would most likely be Exhibit A to my motion”. The outrage in this case by the mayor seems to be a little bit selective, in my opinion. “There are equally egregious things going on where we don’t have any outcry”.

A spokesman for the mayor did not immediately respond to a request for comment. His defense has previously said Van Dyke feared for his life as McDonald reportedly had a knife.

While he didn’t give details, Herbert said he knows what happened that night from Van Dyke’s “perspective”.
