Maliwal had approached Supreme Court seeking a stay on the release of the juvenile convict, who is now 20-years-old and said to have been the most brutal of the five rapists.

Now since the matter of his release is sub judice before the Supreme Court, there is a question mark on what the Delhi Police would do. “He (the juvenile convict) can’t be released as a free person till management committee appointed for goal of deciding whether he’s mentally sound and whether he has been socially mainstreamed and reformed and gives clearance”, ANI quoted Swamy as saying.

The Supreme Court in the weehours of Sunday agreed to take on board a petition filed by Delhi Commission for Women against the release of the juvenile convict in the Nirbhaya gangrape case. The development comes on a day the victim’s parents were detained and later released after they held a protest against allowing the juvenile convict to walk free. The apex court has made a decision to hear the petition on Monday.

“I hope the juvenile convict in Nirbhaya gang rape case is kept in juvenile home until the case is heard”.

“Not only in India, but also overseas, people do not want his release, as he had not done the act of a juvenile”.

The criminal record of the juvenile has been expunged as per legal provisions and his identity shall not be disclosed, sources said.

“Crime has won and we have lost (jurm jeet gaya, hum haar gaye)” was the immediate reaction of the family of the victim.

The student, who succumbed to her injuries two weeks after the attack, was publicly named by her mother on the third anniversary of her death last week, in an effort to end the stigma facing sex attack victims in India.

Sources said the juvenile has been kept under observation of an NGO under the protection of Delhi Police.

“The High Court judgment is correct that the law says three years and no way that any High Court or Supreme Court can change that”.
