An Irish ex-nanny is being deported a day after Massachusetts prosecutors dropped a murder charge against her in the death of a 1-year-old girl.

According to numerous sources, an initial post-mortem exam showed that the child had died as a result of complications from blunt force head injuries.
Prior to her May release McCarthy had been held in prison since her arrest on the murder charge on January 21, 2013.
It is believed the agency have no interest in holding her in custody and they have removed the Global Positioning System monitoring bracelet she was forced to wear since being released on bail in May to await her trial.
She said Ms McCarthy still faced uncertainty as US immigration authorities want to detain her. It is not clear yet if she will be deported.
“This was an absolute nightmare”.
The Rev. Kevin Fay, a priest in McCarthy’s hometown of Lavey in Ireland, told The Boston Globe, “It’s fantastic news, just fantastic news”.
The charges against McCarthy have now been dropped after the state medical examiner found the child had past medical issues and may have had some type of undiagnosed disorder.
“Based on an assessment of the present state of the evidence – including the amended ruling from the medical examiner who performed the autopsy – the Commonwealth can not meet its burden of proof”, District Attorney Marian Ryan said.
In a statement this evening a spokesperson from US Immigration and Custom Enforcement says Aisling Brady McCarthy arrived in the US on a tourist visa in 2002 and never left.
In his ruling, the examiner said the child’s medical history “could have made her prone to easy bleeding with relatively minor trauma”.
“Given these uncertainties, I’m not satisfied that the subdural hemorrhage on this case might exclusively have been brought on by abusive/inflicted head trauma, and I cannot rule the way of demise as a murder”, the medical expert added.
“Particularly the general state of Rehma’s well being and her previous medical points increase the likelihood that she had some sort of dysfunction that was not capable of be utterly recognized previous to her dying”. “
There’s a sense of great relief for everybody.”
