Judge rules Rose accuser must reveal her name publicly

A Los Angeles federal judge ruled Tuesday that a woman accusing National Basketball Association star Derrick Rose of rape can not remain anonymous at her upcoming civil trial. After the Michael W. Fitzgerald, the judge presiding on this case, ruled she can not remain anonymous, things quickly got testy. This is especially so in this case as Jane Doe has admitted during interviews her family doesn’t know she’s the plaintiff in the case.

But many news organizations may stick to their policies of withholding the names of alleged victims of sexual abuse.

Rose admits to having group sex with the woman on the night in question, but he claims the act was consensual.

U.S. District Judge Michael W. Fitzgerald handed down the ruling on Tuesday, as first reported by the Associated Press. The notice they filed claims the woman and her lawyers have attempted to smear Rose’s name and garner public support via the media.

In a glowing profile on the NBA Players’ Association website, Rose admitted he feels more loved by Knicks fans than he did when he played for the hometown Bulls. The woman, an ex-girlfriend of Rose, is suing him for .5 million.

“I felt just dirty”, she told AP in a recent interview.

Both parties have said they remain in negotiations to reach a settlement before trial, which is set for October 4 in Los Angeles. “Like I didn’t want to believe it was true”. He had her name struck from the record.

Soon after Fitzgerald ruled on the issue of the woman’s identity, Rose’s attorney, Mark Baute, revealed the woman’s name and was warned by the judge that she would remain anonymous until trial.

“Do not test my patience”, Fitzgerald said.

The six-month jail term for ex-Stanford swimmer Brock Turner for sexually assaulting an unconscious woman sparked a public outcry over the punishment.

Consent is a primary factor in this case, and was a primary factor for the judge’s decision to deny Rose’s Motion for Summary to get the case thrown out in June. “You feel that a little bit in Chicago, but it’s not on that level of NY, so it kind of makes you anxious to actually get on the court”.
