Kelly Rutherford has custody bid thrown out

The actress maintains she was simply acting in her kids’ best interests after judges in both California and New York insisted they had no jurisdiction over the case, but she was chastised by New York Supreme Court Judge Ellen Frances Gesmer on Tuesday and ordered to immediately hand Hermes and Helena over to their paternal grandmother, who attended the hearing in her son’s place.

Kelly Rutherford is fighting back at claims she “kidnapped” her two young children when she failed to return them to their father in Monaco.

Kelly Rutherford feels like her children’s “voices have not been heard”. On Wednesday following the court finalization, Rutherford made a stated through her lawyer saying “What the judge did yesterday was shocking, illegal, and abusive to my children”. The battle between the two has been going on for over six years.

The actress refused to return them to Monaco last week, as previously agreed, and Daniel accused her of child abduction.

“I walked into a courtroom where everything felt like it was already done”.

However, when the day came she refused to put them on a plane and allegedly ignored emails telling her to comply – until a judge stepped in to deport the children.

Rutherford’s attorney, Wendy Murphy, says the “saddest part” of her client’s situation is that “no American court seems to give a damn”.
