Kelly Rutherford, who played Lily Van Der Woodsen on Gossip Girl, has been in the news lately for a messy, complicated custody battle over her two children, Hermes and Helena.

Actress Kelly Rutherford’s lawyer has defended the actress’ decision not to return her two children to their father in Monaco, insisting she is breaking no US laws by keeping them on American soil.
My first priority is to protect my children.
Rutherford charged that sending the children to Monaco would violate the agreement her ex-husband had agreed to. “I believe Monaco appreciates why it can not assert jurisdiction over my children, and that Monaco will respect my children’s right to reside in their own country“.
In May a California judge ruled that the kids could spend the Summer in the United States, while the custody case moved forward. Rutherford said she has since visited Monaco approximately 70 times.
The actress’ lawyer – who successfully argued that media be excused from the courtroom during the hearing – said the children were “maybe 10 minutes away” because his client had wanted to keep them away from the “media circus”, the mag said.

When paparazzi outside the courthouse asked Monaco how she felt, she teared up and responded, “I think how any parent would feel if they lost their kids”, per TMZ.

And that’s despite the fact that Kel’s kiddos are U.S. citizens, the judge felt that they belong overseas with Daniel while he figures out his U.S. residency issues. Shortly after that announcement, a judge in New York (where Rutherford lives most of the time) also said his state does not have jurisdiction.
