Kelly Rutherford puts aside her child custody woes to shop for grey skinny jeans at Rebecca Taylor in Manhattan on Thursday. In a report from People, Rutherford had to say goodbye to her kids after Judge Ellen Frances Gesmer of the New York Supreme Court ordered the two minor kids were to be returned to their father immediately. Giersch then accused her of child abduction. The parents, who divorced in 2009, had a joint custody arrangement until German-born Giersch lost his U.S. visa and a California judge ruled that the two children should stay with him in Europe.

But she told “Good Morning America”: “He was in communication with them every day”.

Kelly Rutherford opened up about her contentious custody battle with ex Daniel Giersch on Good Morning America today, and we couldn’t feel more sorry for the TV actress. “It was a done deal”. His (Giersch’s) mother was sitting there with plane tickets, smiling, ready to take them (kids). “Nobody had heard our argument”, she explained.

As Gossip Cop previously noted, Rutherford is scheduled to fly to Monte Carlo next month for another custody hearing.

Despite disagreeing with the judge’s decision, Rutherford admits she is glad the handover of her children happened swiftly. Monaco didn’t demand them back, New York just sent them back. “It was a very odd, you know, odd situation”.

‘Never in my worst nightmares did I envision the children’s father to angrily, and unlawfuly take legal action in New York to cause my children further pain, by demanding their forced exile beyond an already too long period of three years, ‘ Kelly wrote in her statement. Rutherford’s attorney Wendy Murphy claims the children’s father was only supposed to keep the children in Monaco temporarily. “I think it was in a moment, ‘Oh, your grandma is here”.
