Following a hearing August. 11, Judge Ellen Gesmer ordered Rutherford to hand the children over to Giersch’s mother, who immediately flew back to Monaco to reunite them with their father.
Rutherford also put up a fearless face, telling the children that they were going to see their papa and that they were going with their Oma. Rutherford’s attorney notes that it states, “when a parent makes an agreement never to establish a child’s residency in a foreign country, especially one where the child has no citizenship, no country can lawfully claim the child as its own resident”. They were fine… smiling broadly’.
Naming and shaming those who allegedly offered their help, Murphy says, “Many congressmen and women said they would help, including (Chuck) Schumer, (Kirsten) Gillibrand, (Barbara) Boxer, Chris Smith, and (Sheila) Jackson-Lee”. In May, the actress won the right to have them come spend the summer with her in the US on the condition she returned them to her ex-husband on August 6. She said, “My goal is their well-being and that they’re safe, happy, healthy kids”. ‘My kids have been through a lot.
‘This whole time, what I’ve had to do is take an overall situation that’s so freakish and try to keep my kids healthy. It looks like she will do whatever she can to get them back in the United States with her, even going against a court order. I don’t want them to be fearful.

Her lawyer explained that this was to protect the children from “the media circus” but the move backfired when it irked the judge. “It was done very civilly”, Garr commented.
