The lawsuit cited a Food and Drug Administration warning that using words such as “natural” or “additive free” in their advertising violates federal law, according to the documents from the lawsuit.

Seth Moskowitz, the spokesperson of the Santa Fe Natural Tobacoo Co., stated on Friday that he could not provide remark on the lawsuit due to the existing policy of the company. Despite the overall cigarette market narrowing in the USA, the sales of these cigarettes is growing and the labels are coming under increased scrutiny and facing legal challenges.

The company is already under a consent order issued by the Federal Trade Commission in 2000 that requires the company to include a disclosure in their advertising that, “No additives in our tobacco does NOT mean a safer cigarette”. The agency directed the company to submit plans for “corrective actions”.

Natural American Spirit is an American brand of cigarette and fine tobacco products, manufactured in the United States by the Santa Fe Natural Tobacco Company.

Parent company Reynolds American earlier this week disclosed they are selling off their rights in the Natural American Spirit cigarettes outside of the U.S. for $5 billion to Japan Tobacco Group.
