TRENTON, N.J. (AP) Authorities say an off-duty police officer shot and killed a man who tried to take a gun away from him in New Jersey’s capital city.

Mercer County prosecutors say the shooting occurred around 9:50 p.m. Saturday on Roosevelt Street. During the struggle, Constantine was shot in the hand but managed to get the gun away from his brother, according to investigators. Witnesses say the man who died, 34-year-old Alfred Toe, grabbed a gun from his brother’s auto and pointed it at another man.
During the altercation, Galuchie said a man identified as Constantine Toe, 30, of Trenton, was trying to disarm his brother, Alfred Toe, 34, who had a handgun.
But Toe’s close friend insists the officer did not identify himself and Toe never reached for the gun. The off-duty officer, who was apparently unaware of the incident until he heard a gun shot, then came outside to see Constantine Toe with a gun in his hand.

The New Jersey State Police processed the scene, and the Mercer County Prosecutor’s Office is investigating the shooting. Alfred Toe’s nickname was Yobo. When Alfred Toe saw his brother held on the ground by an unknown man with a weapon in each hand, he went after the officer. The status of the other man wasn’t known Sunday. “During the struggle, Alfred Toe was shot once in the chest”. Underscoring those incidents, however, was the expectation that officers are expected to carry at all times, and that drinking to excess and committing crimes was the issue.
