The first vote Tuesday afternoon, shortly after jurors received instructions from the judge, was 7 to 5. A third vote Friday morning was 8 to 4.
Prosecutors had asked Ervin to urge the jury to continue deliberations.
The judge sent the jury back to deliberate. But they soon signaled there was no hope for resolving the deadlock.
“The decision for any future criminal proceedings in this case rests with the North Carolina Attorney General’s office”.
He thanked the jurors and the judge.
“We were back to square one”, the foreman said.
“We’ll evaluation the trial transcript, some other proof within the case and absolutely think about our choices on this case”, he stated.
At times they blocked both ends of the courthouse, backing up traffic and causing the police to set up blockades with their bicycles. The Ferrell family’s attorney said there’s no clear answer yet on a second trial. “There was no justification for Randall Kerrick to fire 10 shots into Jonathan Ferrell“. At one point the state had CMPD Captain Mike Campagna on stand saying that Kerrick violated numerous CMPD directives and policies regarding use Of force and use Of firearms, while the defense called a few sergeants to the stand to completely rebut what the captain had just explained.
Due to the protests, the Charlotte-Area Transit System shut down the transportation center.
August 3, opening statements were heard. Notably the jury consisted of eight women and four men, seven of which were White, three were Black, and two were Latino/Latina, according to NBC.
Kerrick, who is suspended from the force without pay, faces up to 11 years in prison if convicted.
Laughrun had no comment after the mistrial was declared and jurors walked past reporters without taking questions. “Some will have different opinions” within the department, he said.
Supporters of Kerrick and Ferrell treated each other quite amicably during the trial. “We encourage people to get their message out, as long as they’re within the laws”, Putney said.
We must change the culture of police that sees unarmed blacks as a lethal threat whether playing in a playground like 12 year old Tamir Rice, driving a auto like Samuel Dubose or seeking help following an accident like Jonathan Ferrell. In the crash, 17 miles from his home, Ferrell lost his cellphone and shoes.
Bowling Green State University criminologist Philip Stinson, who is a former police officer, said he would have expected a mistrial or an acquittal.

Ferrell was killed a little less than a year before an unarmed black man in New York and an unarmed 18-year-old black male in Ferguson, Missouri, died after separate violent encounters with police cases that shined a national spotlight on how police departments treat minorities and sparked calls for widespread reforms. He used the same TV screen that was used to show dashcam video that recorded the final moments before Officer Randall Kerrick shot Jonathan Ferrell in September 2013.
