They are expected to try to gut the prosecution’s case or get it thrown out altogether by a variety of means, including preventing some of Cosby’s numerous other accusers from taking the stand; blocking the use of testimony he gave in a decade-old lawsuit; and making an issue out of the 12 years it took to file charges.
In court documents, prosecutors said there are probably other women who were similarly drugged and violated by Mr. Cosby.
Constand’s version of events strongly suggests Cosby gave her something much stronger than Benadryl.
The timing of the announcement of the criminal charge comes just as numerous depositions were scheduled to begin in a MA civil case against the comedian. The woman in that case is not part of the MA suit. That could change if he is convicted in a criminal case.
By testifying he would put himself at risk because prosecutor could introduce additional material to try to challenge Cosby’s credibility, but not testifying is risky, too, said Paul Robinson, a University of Pennsylvania law professor.
“Shortly thereafter, the victim became incapacitated, and Cosby led her to a couch”.
Baker-Kinney is one of 29 alleged Cosby victims represented by lawyer Gloria Allred. She said she saw Cosby standing in a robe.
In the deposition, Cosby admitted under questioning that he obtained drugs, including Quaaludes, to give to women he sought for sex.

When the interview concluded, he told a reporter that asking him about the allegations was a mark of low integrity and said he’d be appreciative if that portion of the interview was “scuttled”.
But his attorneys have repeatedly denied any wrongdoing by Cosby, who has gone from megastar to pariah in the face of the allegations, which span four decades.

A key question if the Pennsylvania case goes to trial is whether the judge will allow testimony from some of those other accusers to show a pattern of “bad acts”.
