N-Out Sues Delivery Startup DoorDash

In-N-Out has officially filed a lawsuit against the delivery company DoorDash seeking damages and a permanent injunction, due, in part, to tepid burgers.

In-N-Out alleges in a complaint filed on Friday that its trademark was infringed when its name and logo were used by DoorDash in ads and promotions for its delivery service.

Fast food chain In-N-Out Burger has a legal beef with restaurant delivery service DoorDash and wants it to hold the Double-Double and fries.

Over the years, In-N-Out has been aggressive about protecting its trademark with lawsuits filed against copycat restaurant operators as well as other businesses attempting to use similar names.

According to the filing, In-N-Out contacted DoorDash for the first time in April 2-14, requesting that the startup stop using In-N-Out’s logo on its site, and stop delivering or offering to deliver In-N-Out’s food.

In the complaint, attorneys for In-N-Out contend that DoorDash advertises that it delivers the chain’s food, although it is in no way affiliated and has not been authorized to do so.

San Francisco delivery startup Doordash has been doing just that much to the delight of In-N-Out fans, but not In-N-Out itself.

DoorDash is facing trademark infringement case for using the In-N-Out’s logo without the company’s permission. “The quality of services offered by [DoorDash] does not at all comport with the standards that consumers expect from [In-N-Out’s] goods and services”, the lawsuit says.

We reached out to Door Dash to snag a comment, but all their spokesperson would give us is this non-sequitur that sounds like it was copy and pasted out of their online mission statement, “DoorDash uses its innovative logistics technology to deliver the very best food and products in neighborhoods across the country”.

In-N-Out said in the lawsuit that it has no control over DoorDash’s delivery time, “temperature at which the goods are kept during delivery”, or food safety practices. The company – which has a reported valuation of almost $600 million – got into trouble with a few NY restaurants for inflating menu prices.
