Natural cigarette maker faces class-action lawsuit

A Florida low robust has filthy a class-action swimwear against the Santa Fe Natural Tobacco Co. and its protector service specialist, Reynolds American Inc. for perplexing people in general having their product.

Parent company Reynolds American earlier this week disclosed they are selling off their rights in the Natural American Spirit cigarettes outside of the United States of America for $5 billion to Japan Tobacco Group.

Santa Fe Natural Tobacoo Co. spokesman Seth Moskowitz said Friday, October 2nd that he could not comment on the lawsuit because of company policy. These claims on the label are under scrutiny and being met with legal challenges, reports Santa Fe New Mexican.

Santa Fe has been using the words to market its American Spirit brand of cigarettes since it was founded over three decades ago.

Santa Fe Natural Tobacco already is subject to a Federal Trade Commission consent order, entered in 2000, that requires the company’s advertising to include a disclosure that “No additives in our tobacco does NOT mean a safer cigarette”.

In a letter dated August 27, the FDC asserted its authority under a 2009 law to regulate “modified risk tobacco products”.

A month before the warning the cigarette manufacturer had kicked off a national advertising campaign and brought full-page ads in US Weekly, Vanity Fair, Southern Living, Time, Sports Illustrated, Field and Stream, and other magazines.

Reynolds American stated in a regulatory filing posted on its website that American Spirit is the “leading super-premium cigarette brand and is a top 10 best-selling cigarette brand”.

Meanwhile, it is also learned the company has submitted an explanation to FDA related to the marketing strategy.

The plaintiff’s claim these terms violates federal law and is deceptive.
