It now appears that things started to go downhill for Smith on Thursday. The situation that happened could have been handled differently. “I think everybody was shocked. That’s all”. This after he was sentenced to 11 days of work release in July 2014 in Santa Clara after his September 2013 arrest for drunken driving. He then left on foot. When officers arrived, Smith came back to talk to the officers, who suspected Smith was under the influence. He is accused of hitting a car while parking, causing vandalism by hitting the same car with his door when exiting his vehicle, and then leaving the scene, police said, adding that Smith later returned to his car and was arrested.

Smith was attempting to park his vehicle, described as either a large SUV or truck, and allegedly crashed into an adjacent parked auto that was unoccupied, according to Clarke.

Focusing entirely on Smith, one has to wonder if the fight with Kaepernick at 49ers practice on Thursday had anything to do with the events that ultimately led to his arrest early on Friday morning.

“He has been turning his life around. But Haley said he had been unable to return the call because of his duties surrounding his Hall of Fame induction Saturday.

“It was sadness, that’s what it was, sadness for a guy, a person”. “The guy is working really hard and he had a pitfall”.

Smith denied he was driving under the influence during a brief interview with a local TV station before Tomsula’s news conference. “Deeply”.

Smith no stranger to breaking the law has found himself in trouble since 2012. The following year, in connection with the same incident, the NFL suspended him for the first nine games of the regular season for violating the league’s personal-conduct and substance-abuse policies.

Smith was previously arrested on April 13, 2014, at Los Angeles worldwide Airport. First, prosecutors will meet with Santa Clara police and decide whether to file charges on the new allegations.
