Now hospitals that overwork junior doctors face financial penalties, but these would be removed under the new contract.
The British Medical Association, which is negotiating on their behalf, maintains that junior doctors and patient care will suffer as a result of the new contract, whereas the Government maintains both with be better off.
Junior doctors representatives will resume negotiations with the Department of Health and NHS Employers in a bid to avert two days of further strike action planned in a dispute over new contract terms.
They say like all NHS Trusts they have been working hard to ensure that as few patients as possible are affected by today’s industrial action.
Thousands of junior doctors walked off the job Tuesday in England in a bitter dispute over pay and working conditions – the first such strike in 40 years.
“We don’t want to strike this is a last resort”, Miriam Anderson, and A&E trainee said.
According to media reports, a West Midlands hospital has also asked doctors to come off the picket line to help after a surge in patients.
Senior house officer in cardiology Dr Claire Coyle said: “Tired doctors make mistakes and that is why it is so disappointing the government has failed to engage with our concerns about safe guarding junior doctor working hours”.
There are more than 55,000 junior doctors in England – covering those who have just graduated from medical school through to those with more than a decade of experience.
And a nine-hour walkout, when they intend to withdraw their labour completely, is scheduled for February 10.
Talks between the BMA and NHS bosses are continuing, with issues including weekend pay and the need for appropriate safeguards in place to stop doctors over-working.
UK Prime Minister David Cameron on Monday urged the doctors to abandon what he said was a “damaging” strike. “It means that we have been able to get our message across”.
The Government wants to cut the number of hours classed as unsociable, meaning these doctors will earn less money for evening and weekend work.

Johann Malawana, chair of the BMA junior doctors committee, said: “Junior doctors feel they have been left with no option but to take this action”.
