Meanwhile, Justice Ahmed Mohammed of the Federal High Court in Abuja on Wednesday withdrew from the trial of Kanu, and returned the case file to the Chief Judge of the court, Justice Ibrahim Auta, for re-assignment to another judge.
Kanu had refused to take plea before Justice Mohammed on the ground that he would not get fair trial.
Kanu said he lacked confidence in the court, and that based on information available to him, he might not get a fair trial.
Grabbing a microphone from a court official, thebfreedom fighter thundered: “I will not sacrifice the due process of the law founded in the principles of natural justice upon the altar of speedy release from detention”.
The accused, who was arraigned before Justice Mohammed Wednesday, told the judge before commencement of the prosecution’s plea that he preferred being held in detention than subjecting himself to a trial, which outcome he noted, would not be respected by the government.
“Previous court judgments and rulings have been delivered by competent courts of law in Nigeria in my favour which the Department of the State Security Service failed to obey or implement”.
The Director of Public Prosecutions (DPP), Mohammed Diri opposed Kanu’s submission on the grounds that he ought to take his plea before raising any objection.
But his counsel, Mr Vincent Obetta, stood behind his client and asked the court to oblige his client’s request.
In his ruling, Justice Mohammed agreed that the accused person has the right to object to his trial before his court on the ground that justice is rooted on confidence.
