NY court says fraud suit over Trump University can continue

A NY appeals court on Tuesday revived a fraud claim the state attorney general brought against Trump University, a for-profit investment program. “New York Attorney General Eric Schneiderman continues to waste taxpayer money trying to smear me, but the fact is that the overwhelming majority of students had a great experience”.

Trump, now seeking the Republican nomination for president, has denied any wrongdoing.

Schneiderman sued Trump and Trump University in August 2013, alleging the school swindled students out of $40 million by operating an unlicensed educational institutional and misleading students by promising they would gain real estate investing expertise.

Tuesday’s ruling, however, found the lower court had incorrectly dismissed the fraud complaint, while siding with the New York AG’s contention that a six-year statute of limitations applied in the case, versus the three-year cutoff argued by the defendants.

“Trump University has a 98% approval rating and an “A” rating from the Better Business Bureau”, Trump said in a statement Monday, prior to the ruling”. Its name was changed to the Trump Entrepreneur Initiative before it closed in 2010. The lawsuit seeks restitution and damages for more than 5,000 students nationwide, including 600 New Yorkers, who paid up to $35,000 each.

Trump and his allies have aggressively pushed back against Schneiderman, accusing the attorney general of trying to solicit campaign donations from Trump’s daughter and son-in-law shortly before he filed in the suit in 2013.

Trump’s fellow Republican candidates have attacked him over litigation against the school, including a class-action suit in California. The ruling comes as Super Tuesday primary voters head to the polls.
