NY Jets receiver testifies at civil assault trial

Though that incident didn’t result in any criminal charges for Marshall, a civil trial is only just beginning. His lawyers wrote that Myles was struck in the eye during an altercation she instigated.

In a deposition read aloud in court, Sims-Walker said Marshall left the club after his wife was struck by a bottle that left her with a bloody lip and several teeth knocked out.

Marshall’s attorney, Harvey Steinberg, did establish some inconsistencies in Myles’ account of the events of that night under cross examination.

“If I need to, I’ll take the blame; I’ll say I hit her”, Sims-Walker, who played with Marshall at Central Florida and played for the Jaguars and Rams, said that he texted to Marshall.

Myles told the jury Marshall, who again was present in court, had punched her with his right arm and not his left, and that she recalled seeing tattoos and a blue sleeve at the time of the punch that she later learned were consistent with Marshall’s appearance that night.

Apparently, former National Football League receiver Mike Sims-Walker was paying close attention during Cris Carter day at the 2007 Rookie Symposium.

As previously mentioned, Marshall wasn’t criminally charged. Footage from security cameras at the club showed what sparked the incident that ruined Myles’ party.

Marshall was a member of the Miami Dolphins at the time but was traded to the Chicago Bears two days later. Myles also said, however, that her former attorney had done that against her wishes. But the video is grainy and choppy; Myles claims Marshall hit her, but it’s not exactly clear whether that’s true.

“I have a feeling if he wasn’t a professional athlete we wouldn’t be in this courtroom”, Steinberg said. Steinberg also showed security footage from outside Marquee, where the punches occurred, then reenacted the balled-fist punch that Myles threw toward Marshall and his entourage – spinning to emphasize the gusto and span of Myles’ tipsy swing-and-miss.

However, Steinberg pointed out that in a moment captured soon after the alleged punch, video appeared to show Marshall’s sweatshirt sleeve rolled all the way down.
