High Court Judge Thokozile Masipa ruled a year ago that the state had failed to prove Pistorius had shown “intent” or “dolus eventualis”, a legal concept by which a person can be held responsible for the foreseeable consequences of their actions.

His fate will be sealed later this week when Justice Eric Leach announces the decision of a five-strong panel at the Supreme Court of Appeal.

Pistorius’ lawyer Barry Roux argued that the original trial verdict could not be challenged on its factual findings.

Prosecutors have appealed for the Olympic and Paralympic runner’s conviction to be overturned and replaced with one for murder, which could carry a 15-year sentence.

The five appeal court judges did not consider the facts but the application of the law, in a highly technical case.

But defence lawyers say he cannot afford further legal battles, having already paid huge legal bills.
