Prosecutors ask for maximum sentence against Subway spokesman Jared Fogle

TMZ reports that Jared Fogle recently told the judge in his case that he should get the minimum prison sentence because the minors he had sex with were 16 and 17.

Attorneys for Fogle want the federal judge in Indianapolis to give him a five-year prison term – less than the 12 years and seven months that federal prosecutors are seeking.

Fogle will be sentenced Thursday on possession of child porn, and engaging in sex with a minor. In addition to serving at least five years in prison, he will also pay $1.4 million in restitution to 14 minor victims, and will now be required to register as a sex offender and undergo treatment for sexual disorders. She described being secretly recorded at age 14 by Russell Taylor, who ran a nonprofit Fogle started to raise awareness and money to fight childhood obesity.

Fogle’s attorneys are asking the court to take his medical condition into account. The court filing discloses that investigators found that Fogle “has paid for commercial sexual activity with adults on hundreds of occasions”.

Attorneys claim Fogle was not a high-level distributor or a producer of child porn.

“Fogle has sacrificed absolutely everything he had built – including his family – to engage in sexually explicit conduct with two minors”, prosecutors said. They also recommend “a lifetime period of supervised release”.

Taylor has separately agreed to plead guilty to child exploitation and child pornography charges. Instead of telling Taylor to stop, Fogle encouraged him to take more pictures.

Subway severed its relationship with Fogle after the allegations surfaced.
