May 9: Supreme Court rejected the plea to vote by nine Congress MLAs, who were disqualified from the Uttarakhand Assembly, during the floor test on May 10.

A peeved Bharatiya Janata Party (BJP) claimed the Congress’ jubilation would be “shortlived”. Aam Aadmi Party chief Arvind Kejriwal tweeted, “Uttarakhand floor test outcome is a huge setback for Modi government”.

The top court has said that Harish Rawat can take charge as the Chief Minister of Uttarakhand again.

The BJP has 28 MLAs, including that of Bhim Lal Arya whose loyalty is in doubt. “The Congress used money and muscle power. I have taken instruction from the government… that we will revoke the President’s rule”, the AG said.

The Congress Party claimed victory soon after a trust vote was conducted on the floor of the Uttarakhand Legislative Assembly on Tuesday, triggering celebrations among its members.

A bench of Justices Dipak Misra and Shiva Kirti Singh, during the course of hearing of the appeals against the Uttarakhand high court judgment quashed President’s Rule in the state, had ordered a “floor test” by keeping President’s Rule in abeyance during the voting period.

The rebel MLAs were subsequently disqualified by the Speaker under the anti-defection law, a decision that was upheld by the High Court and not interfered with by the Supreme Court. It will have a roller-coaster ride till Assembly elections, scheduled for early 2017, are held.

Rawat said that he was indebted to his party leadership, especially party president Sonia Gandhi and vice-president Rahul Gandhi, for the support and for starting a movement in the nation to “save democracy”.

Asserting that imposition of President’s Rule just before the floor test on March 28 went against the principles of the Constitution, Chowdhary also said that the communal forces must not be allowed to flourish in the nation. Orders floor test in Assembly on April 29.

Moments after the high court pronounced its order, the MLAs moved the Supreme Court. “The Congress majority in the assembly was a result of purchase and sale of elected members”, BJP leader Shrikant Sharma told IANS outside parliament. Their intention was to topple the Harish Rawat government.

Observing that in the past one-and-a-half months the state suffered losses, Rawat said, “What ends well remains well”.
