Rose’s accuser can’t remain anonymous

New York Knicks point guard Derrick Rose will be a part of a civil trial that will begin in a couple of weeks.

Derrick Rose is due in Los Angeles court on October 4 for a civil sexual battery lawsuit where the plaintiff, Jane Doe, has accused Rose and two friends of a 2013 gang rape. Back in August, Rose’s attorneys argued that revealing the plaintiff’s name would allow the media to vet her allegations, and that she could still be protected by ‘appropriate restrictions on the media and public access to the proceedings.’ Later in the same filing, his lawyers argued that strict restrictions on naming her would not be necessary, ‘partly because the media has to some degree lost interest in this case.'”Werly previously pointed out in The White Bronco that revealing Doe’s identity could negatively impact the victim’s settlement negotiations:”If the judge rules that she cannot remain anonymous at trial, Doe’s settlement negotiation position will significantly weaken”.

Last week, the woman gave an anonymous teleconference interview to various media outlets, and several publications, including the Associated Press, wrote stories about what happened the night of the alleged sexual assault based on her recollection. Rose and the others deny her claims and contend they had consensual sex with her that night.

This past summer, Rose’s lawyers had been petitioning the court to prohibit their client’s accuser from using the Jane Doe pseudonym in court documents and during the trial because the 30-year-old woman had forfeited her right to privacy because she had been “publicly portraying herself as sexual” on social media platforms in the past.

“They’re elderly and I’m a part-time caregiver for my mother, so it’s very important for me to do everything I can to make sure that my family’s needs are met and they’re still in good standing and have no stress or pressure placed on them”, she said.

“I think because her name is not revealed now, she isn’t in complete panic”, he said.

Two weeks from the trial, Fitzgerald ruled in favor of revealing Doe’s identity, amid concerns Rose would not receive a fair trial should she remain anonymous. She texted Rose the next day to ask what had happened, reported the AP, but he wouldn’t answer. He played seven seasons in Chicago, according to the AP, where he won Rookie of the Year and MVP honors.

“I felt just dirty”, she told AP in a recent interview. She claims that when she awoke the next morning, her dress was over her head and a used condom was on the floor of her bedroom, the Tribune reports.

Rose and the woman dated non-exclusively for two years before the alleged rape.

He said the law was “very clear on the issue” and he would not close his court room to protect her identity.

“Do not test my patience”, Fitzgerald said. She says that in August 2013, she was hanging out with Rose and his friends, got so drunk she passed out (her lawyer says it’s possible she was drugged), and was taken to her apartment in a taxi.

The trial has garnered national attention in the weeks leading up to its start, both for the case’s high-profile defendant and the country’s continued heated argument about rape, sexual consent and accountability in the courts when it comes to sentencing the convicted.

No criminal charges have been filed in the case. “You feel that a little bit in Chicago, but it’s not on that level of NY, so it kind of makes you anxious to actually get on the court”.
