Samsung agrees to pay Apple $548M in damages with conditions

This was after the courts closed down and rejected Samsung’s appeal to pay Apple damages.

Samsung is expected to pay the outstanding damages by 14 December 2015, but has reserved the right to collect reimbursement if there are any further developments in the case. In late August Apple asked the court to order Samsung to pay over $548 million in damages, in a long-drawn patent dispute between the two companies that dates back to 2011.

Apple Inc. (NASDAQ:AAPL) and Samsung Elect Ltd (OTCMKTS:SSNLF) are fighting over patents in court yet again. That total was reduced on appeal to $930m.

After a big original victory for Apple, when Samsung was ordered to pay over a billion dollars in damages, the case has gone through numerous appeals and negotiations.

In November 2015, Samsung filed a petition to get a hearing by all the judges of the US Court of Appeals on whether Apple could enforce damage payments, but the petition was denied.

Unfortunately this may not be the end of the back-and-forth court battle between Apple and Samsung, for while they agree on this settlement payment, the South Korean company has stated that it “continues to reserve all rights to obtain reimbursement from Apple”, meaning if any judgement is reversed or changed in Samsung’s favor, it wants the money back. Apple is appealing against this decision. The Federal Circuit refused to go along with Samsung.

When the case started, it was expected to be a long drawn process as the complexity surrounding patent issues are not easy to comprehend. “Apple disputes Samsung’s asserted rights to reimbursement”, said Apple. Surprisingly, Apple is yet to file cases against Xiaomi for patent infringement.

Patent watcher Florian Mueller, who first reported the joint statement, noted Samsung has vowed to petition the Supreme Court to review damages related to Apple’s design patents.
