The unidentified man, who police say may have been intoxicated, was involved in a collision with a crossing guard at a set of rail tracks in Sunnyvale, just outside San Jose.

An unoccupied vehicle on the tracks was struck by two different Caltrains Monday evening in Sunnyvale, according to Caltrain officials.

Ackemann says transit police were responding to a call near the scene of the crash and removed a person from the vehicle before the train struck it.

Salvador Zuno, of the San Mateo County Sheriff’s office, said: ‘If it had not been for the deputies being at the right place at the right time, the driver would have been significantly injured.’. But within seconds, a northbound Caltrain’s horn can be heard as it barreled down the track, heading straight for the auto.

In June a man tried to cross a rail track oblivious to the high-speed train hurtling towards him, just a few months after a teen soldier was hit by a train at the same spot.

According Mr Zuno, the driver appeared to be under the influence.
