SC: Do you think we can bring in Ram rajya?

“If we were say that there should be Rama Rajya, will it come?” Had our orders run so effectively then we would pass orders directing that no one should indulge in corruption of crime.

Observing that court can not find a solution to all the ills in the country, the Supreme Court on Friday said it does not have a magic wand to create a Ram Rajya. But our capacity to monitor is limited and that is the problem. Ieshdhan was citing the SC’s order of September 5, 2014 seeking status reports from states and union territories on steps taken to remove encroachmentsfrom footpaths. “It can not be like this”, a bench headed by Chief Justice T S Thakur said. We can not order that murder should come to an end.

CJI T S Thakur, while hearing a PIL seeking directions for removal of encroachments on pavements across the country, said the Supreme Court can not be expected to pass orders on every issue bothering the country and create a Ram Rajya.

The bench also comprising of Justices AM Khanwilkar and DY Chandrachud, tried to reason. “This is a problem”, he said. You are here to protect our fundamental rights.

The petitioner told the court that there were encroachments on footpaths and roads not only in Delhi but across the entire country. Chief Justice Thakur initially asked the court security personnel to remove the petitioner from the courtroom. If you can not do that, what is the point of having fundamental rights under the Constitution?

When the bench asked the petitioner to approach the High Court first, he said, “How many High Courts will I go to. this court should hear this matter”.

Subsequently, the bench tried to pacify the petitioner.

As Ieshdhan persisted with his prayer, the court directed the hearing of the plea by an appropriate bench in February next year.

When the petitioner told the bench that there was rampant encroachment on the roads and footpaths across the country and authorities were doing nothing, the bench said, “You can educate the people about this”.

The bench’s query came Ieshdhan, who heads NGO Voice of India – persisted with his plea even after the bench made a decision to dismiss it.
