Split Court Would Uphold Blocking of Obama Immigration Executive Action
Supporters of President Obama’s immigration policies rally outside the Supreme Court. Justice Kennedy later followed up on that question, asking Erin Murphy, who represented the House of Representatives, whether the appropriate challenge might not have been a claim brought under the Administrative Procedure Act – a question he’d previously posed to another Solicitor General. Nevada has one of the highest numbers of undocumented immigrants in the country that could qualify for deportation relief.
“We know this is not unconstitutional”, she states.
President Obama approved DAPA, but Congress never agreed to it. Under the U.S. Constitution, Congress usually makes the laws, and the president’s administration makes sure the laws are followed. What is the significance of that decision?
If the Supreme Court ruling expected by this summer defeats DAPA, Schommer said, “All the people who gathered their evidence in anticipation of applying, are not going to have anything to apply for”. It was challenged very quickly after the president rolled it out in 2014, by Texas and a bunch of other states.
A 4-4 split by justices would leave in place a lower court’s decision blocking Obama’s action in a severe blow to the president. The court heard arguments in the case on Monday. “What the president is doing here is without historical precedent in the history of the country”, said Dan Stein, president of the Federation of Americans for Immigration Reform. Congress, the president and the elected branches of government should be the ones to decide.
Omar Martinez says he’s anxious about the outcome of the presidential election with tough rhetoric about immigration.
The Supreme Court’s Justice Anthony Kennedy is being closely watched. I have never heard as much Spanish spoken out here, on the steps, in the bathroom.
Many supporters camped overnight outside of the Supreme Court building in Washington on Sunday. It is a group that feels strongly in this case.
A Tucson woman who said she came to the United States 16 years ago in search of a better life said her greatest fear is that she will be deported and be separated from her son who was born in the U.S.
More than 30 undocumented mothers who would benefit from DAPA participated in a 48-hour fast outside the Supreme Court, praying that the justices see the case the way they did. This is a tough case.

The oral arguments might not be indicative of where the judges ultimately stand and they may work to broker some sort of compromise behind closed doors.
