Janice Dickinson’s defamation lawsuit against Bill Cosby should move forward, a judge ruled Tuesday, saying a trial can determine the truthfulness of the model’s claims that the comedian raped her in 1982.

“Either the rape did occur or it did not occur and Dickinson is either telling the truth or not telling the truth”, said Weintraub.

Cosby’s attorneys have argued that Dickinson’s story has changed over the years.

Dickinson says she tried to include the story in a 2002 memoir, but her publisher refused.

In the lawsuit, Dickinson and her lawyer accuse Cosby and his legal team of making a “false statement” and that the comments made “were written and published with the goal of making Ms. Dickinson an object of ridicule, contempt, hatred or disgrace, and to bring her public and personal humiliation”.

Speaking to the Daily Mail, the reality TV star struggled to hold back the tears after she recounted the moment she received the devastating news.

“I want Bill Cosby in court”, she said.

“When the doctor found the lump, it hurt”, the 61-year-old said.

The news came one day before Dickinson’s ongoing defamation case against Cosby was due in court again in Los Angeles for a hearing on Cosby’s latest motion to dismiss.

She was also a cast member of VH1’s “The Surreal Life” and UPN’s “America’s Next Top Model”.

There’s no date for the trial yet, and Cosby’s lawyers will have the opportunity to continue to try to keep their client out of court.

However, Savannah, 22, was out shopping with her mother when she got the call to confirm the diagnosis, and Janice admitted, ‘I just was really glad that my daughter Savannah, she likes to be called Savi, I was really glad Savi was with me at that moment because it was kind of an out of body experience.

There are dozens of women who have accused Cosby of sexual abuse.

“If you look at the deposition you will see that there is no admission of criminal wrongdoing with respect to Mr. Cosby”, Cosby’s attorney Monique Pressley said during an appearance on “The Today Show” last December.
