The “Empire” actor is trying to overturn a 2012 divorce agreement with his ex-wife Michelle Ghent by accusing her of extorting him for thousands of dollars.

Howard’s attorney also produced another witness in the form of his sister-in-law Yvonne Howard, who declared that Ghent had told her once that she has the footage of the actor having sex with a woman while the act is being filmed by another woman, TMZ reported.

Howard and Ghent married in 2010 and applied to divorce a year later.

According to the recording, Ghent is heard saying that she will bury the actor deep in the ground.

He also claimed she threatened to sell a video of Howard singing in the bathroom naked, which she claimed she could get $2 million for, as well as call the IRS on him. She also claims Howard still owes her money under the settlement.

Howard contends the statements by Ghent amounted to extortion and that the divorce settlement should be overturned.

In the meantime, reports New York Daily News Ghent, has accused the actor of infidelity, domestic violence, and hiding money from her.

Ghent’s lawyers say she denied the allegations during a deposition.

The dispute has prompted 20th Century Fox, which produces “Empire“, to seek guidance on where to send Howard’s “Empire” earnings.
