A BBC investigation, led by BBC Scotland boss Ken MacQuarrie, found that Clarkson had subjected the 36-year-old Irishman to a 30-second physical attack and sustained verbal abuse.

Tymon is suing both Clarkson and the BBC for racial discrimination and personal injury.

He is said to have called Tymon a “lazy Irish c–“, which is understood to be the basis for the racial discrimination element of the claim.

Mr Tymon’s law firm Slater and Gordon said it would not comment on the case.

The assault took place at a North Yorkshire hotel, after Clarkson was told there was no hot food available at the end of a day’s shooting on location.

In July, it was announced that he plus co-stars James May and Richard Hammond had signed a deal with streaming service Amazon Prime to make a new series about cars.

Following the publication of the report, Tymon informed police that he did not wish to press charges.

“It was determined that Clarkson’s attack had ‘resulted in swelling and bleeding to [Tymon’s] lip”.

In a statement following Clarkson’s dismissal in March this year, Tony Hall said it was with “great regret that the BBC would not be renewing Clarkson’s contract”.
