McMonagle cited legal precedents and argued the Pennsylvania law should apply, given that all of the alleged events and circumstances involve Pennsylvania, and Pennsylvania has a greater “interest” in the case than Canada.

Allred rejected Wyatt’s accusations, saying Cosby’s becoming desperate and that several accusers she represents are black.

The statement targeted lawyer Gloria Allred, who has represented some of the women who accused Cosby of sexual misconduct.

It’s likely that Cosby’s attorneys will try to prevent the women from testifying.

Allred writes that ultimately the Pennsylvania case is about whether or not Cosby is guilty.

Each alleged victim claims that she was sexually assaulted by Cosby after being drugged.

After the hearing, defense lawyer Angela Agrusa faulted the media for not investigating claims by dozens of other women who have come forward in the past decade.

“I know this is a beep, ‘ Cosby said”. However, according to Cosby, he gave Andrea Constand Benadryl before fondling her with her consent.

Judge O’Neil has reserved judgment on whether or not they will be allowed to testify.

A USA judge on Tuesday set June 5 as the date on which comedian Bill Cosby will go to trial for sexual assault. Cosby’s lawyers also plan on filing a motion in the next 60 days to move the trial venue from Norristown, Pennsylvania, to another city.

After giving her three blue pills, Constand says the comedian touched her inapproprately.

The comedian is accused of drugging and molesting Andrea Constand at his Philadelphia home in 2004.

Prosecutors want to use a phone call between Cosby and and Constand’s mother, Gianna Constand, as evidence in the case. Judge O’Neill did not immediately rule on the motion.

Cosby has so far lost his efforts to have the charges thrown out.

In July, Cosby’s legal team tried to ask the court to dismiss the case, citing the reason that they were not given the opportunity to cross-examine Constand. He ran against the prosecutor who had declined to charge Cosby in 2005.

The judge did declare Cosby blind – he was seen being guided into and out of court.

“I told him, ‘I can’t talk, Mr Cosby.’ I started to panic”, she said in a criminal complaint in December past year.

The judge also said he would set a date for testimony and/or argument on the second defense pretrial motion.

McMonagle said he intends to bring an expert on board to help find a county where a fair and impartial jury can be selected.

The defense is expected to oppose such testimony. Cosby settled the suit after four days of questioning.

The defense also will push on Tuesday to keep key evidence out of the case.

They’re calling for an end to the statute of limitations in response for rape and sexual assault. McMonagle said allowing the recording to be used as evidence based on Canadian law would amount to abiding by the rules of any country where such as a call originated, regardless of whether the foreign law passed U.S.

Constand’s mother secretly taped a phone conversation in which Cosby described his sexual encounter with her daughter as nothing more than “digital penetration”. The women ― who were not named in the motion ― were selected from a list of roughly 50 alleged victims that prosecutors reviewed.

The 79-year-old required a cane and an aide to make it from his vehicle to the Pennsylvania courthouse where the date was set.
