Trump’s Travel Ban Is On Hold, But Court Challenges Press On

The initial order, which was signed January 27, suspended entry for visitors from seven predominantly Muslim countries for at least 90 days and froze the entire US refugee program, The Journal reported.

Trump appeared to base his conclusion about the U.S. Court of Appeals for the 9th Circuit’s unanimous decision to uphold a lower court’s order to stop the Trump administration from implementing the travel ban on a segment on MSNBC’s “Morning Joe” program.

One of those options might involve rewriting the controversial executive order, or replacing it with a new one, to sidestep the legal issues which have caused the travel ban to become held up in the courts. News reported Trump hasn’t decided whether he will appeal the decision to the Supreme Court, but he may be considering writing a brand new order.

The three-panel appellate court in San Francisco is expected to rule on the travel ban this week. However, it is not going to be persuasive to other courts, and would likely be overturned or limited to the facts of this particular case, eventually.

The ban also banned the refugees from these seven mostly Muslim dominant countries from entering the U.S., in the name of national security.

The U.S. Supreme Court is minus a justice and it is viewed as ideologically split, 4-4.

Trump tweeted his reaction.

“We will be doing something very rapidly to do with the additional security for our country”.

Mr Trump signed in a 90-day travel ban on people from Syria, Iran, Iraq, Libya, Somalia, Sudan and Yemen as well as dual nationals.

The initial executive order created worldwide chaos.

He issued an all-caps tweet shortly after Thursday’s 3-0 court ruling: “SEE YOU IN COURT, THE SECURITY OF OUR NATION IS AT STAKE!”

“Judges are given life tenure so they can go wherever the law takes them knowing that they can resist being unduly influenced by criticism or by praise”, he said, according to CNN, noting that “all the way back to Thomas Jefferson, there has been criticisms by Presidents as well as (the) general public”.

In upholding the suspension, the USA court of appeals in San Francisco said Thursday the government had provided no evidence that any alien from the countries named in the order had carried out a terrorist attack on USA soil.

“His comments were misrepresented”, President Trump said at a SCOTUS Listening Session at the J.W. Marriott in Washington on February 8.
