U.S. government suing North Carolina over its anti-LGBT law

The campaign between McCrory and Cooper is expected to be one of the most competitive and expensive races this year.

A judge could begin hearing arguments in the competing cases within weeks, during which North Carolina will probably try to stop the government from temporarily blocking the law or stripping away federal funding, said Rina Lindevaldsen, a Liberty University professor.

A potentially epic clash over transgender rights took shape Monday when the U.S. Justice Department sued North Carolina over the state’s new bathroom law. Discrimination against women and discrimination against gays and lesbians (and transgender people) all are rooted in stereotypes about “proper” expressions of gender and sexuality.

UNC President Margaret Spellings, who started her job in March, has said while the university system is obligated to follow the law, it did not endorse the law. “This is about the dignity and respect we accord our fellow citizens and the laws that we, as a people and as a country, have enacted to protect them”, she said. Spellings’ memo noted that the new law doesn’t address enforcement.

Republican Governor Pat McCrory alleged that the federal government is “being a bully…trying to define gender identity, and there is no clear identification or definition of gender identity”. That is why this morning I have asked a federal court to clarify what the law actually is.

But instead of moving to repeal its discriminatory “bathroom bill”, the state is doubling down by suing the Obama administration to prevent federal sanctions.

The lawsuit was filed Monday just hours after Gov. Pat McCrory filed his own lawsuit over the law.

With HB2, Gupta said, McCrory and North Carolina are exhibiting a “pattern or practice of resistance” to transgender employees of public agencies fully enjoy their Title VII rights.

Title VII of the 1964 Civil Rights Act deals with employment law and discrimination.

Stars such as Bruce Springsteen and the members of Pearl Jam have canceled shows in North Carolina over the law.

The state university system was expected to issue a separate response to the warning letter.

Supporters of the law say policies that allow transgender people to use toilets according to their gender identity increases the threat of sexual assault.

Several other states in recent months have proposed similar laws limiting protections for gay, bisexual and transgender people.

Lynch’s dismantles HB2, a law that, “provides no benefit to society”, by placing it in the context of our nation’s many civil rights struggles.

“We’ve had a long history in MS of bigotry and discrimination, and House Bill 1523 brings that back to life”, said Oliver Diaz, a former state Supreme Court justice who filed the lawsuit Monday in U.S. District Court in Jackson.

North Carolina’s Republican members of the U.S. House of Representatives have given the Department of Education until Friday to say whether officials will punish the state for its controversial HB2 law by withholding federal funds from public schools and universities.

The state’s law bans individuals from using a public restroom that does not correspond to the sex on their birth certificate.
