The agency is advising affected consumers to power down their phones and return them to wherever they bought them.
The Note 7 has been a hot topic since its release last month due to reports of the device exploding.
The case is Strobel v Samsung Electronics America Inc et al, Florida Circuit Court, 15th Judicial District, Palm Beach County. Fortunately, most United States retail locations should be able to offer consumers replacement Note 7 phones beginning 21 September.
“[Pointing at failed battery] These two cells have failed and expanded greatly and luckily these aren’t at risk of exploding or catching fire because they haven’t been punctured but if they were punctured in the center of the cells they would be facing the same sort of dangers the Note 7 lithium ion batteries would be”, he said.
A week later, the company and the commission issued separate statements that urged consumers to stop using the Note 7.
It was seen as a big enough safety hazard that the Federal Aviation Administration (FAA) issued a warning to discourage owners from turning on and charging their Note 7 units on board aircrafts. Samsung attributes the problem to the phone’s battery and plans to release new Note 7s that fix the issue by September 21.
So far, Samsung’s official advice to its customers is to turn off the device and return them as soon as they can. “But I’m not going to go get it the first week”, he added, because he wants to make sure there aren’t more problems with the Note 7 replacements. It’s an excellent phone. Customers with recalled phones can exchange them for a new Note 7, a Galaxy S7 or S7 Edge or a full refund.

Kaye said consumers should check the identifying number on the back of the phone at Samsung.com to determine whether their phone has a defective battery.
